STEP 2: Amicable debt collection. If the debtor does not proceed with payment, we move on to the amicable debt collection process. Here, we approach your customer without involving the court. On our behalf, we send a summons, a final written reminder to pay. Our experience shows that this effective approach results in direct payment in 85% of cases after the first or second summons.

STEP 3: Judicial debt collection. If the amicable process does not yield the desired result, with your consent, we proceed to the next step: judicial debt collection. This may involve filing for the debtor’s bankruptcy, seizing various assets with the help of a bailiff, or initiating a legal proceeding.

A court procedure typically lasts between one month and 8 months, depending on the defense presented by the debtor. At our debt collection agency, we offer a No Win, No Fee debt collection service. This means you only pay when we successfully conclude the procedure. Here are the benefits of our No Win, No Fee debt collection:

1. No payment if there’s no result: If nothing is collected in the extrajudicial process or if we do not win a legal proceeding, there are no honorarium costs for you. You only have to pay the administration costs of 250 euro excluding vat.
2. Debtor pays collection costs: In the case of extrajudicial debt collection, the debtor is responsible for covering the collection costs. If a legal proceeding is initiated, the court will be asked to order the debtor to pay both the collection and process costs, allowing us to recover our fees largely from your debtor.

Administration costs

Although we do not charge a fee if a case is not won, we do charge administration costs. We use a fixed amount of a one time payment of 250 euros excluding VAT to create a collection file. This amount must be paid at the start of the case. When legal proceedings need to be initiated in court, another payment must be made. The amount of this amount depends on the amount of the court fee that we have to pay to the court. Costs must also be incurred for summoning the debtor for the procedure. At the start of a procedure, we will always indicate in advance what the costs are. This way you will not be faced with any surprises.
